Terms Of Service

By accessing or using the Persona mobile application made available by Persona (hereinafter referred to as "Persona", "we", "us" or “Service”), you agree and affirm that you have read and accept these terms of use. The Service is owned or controlled by Persona.
By using the Service, you indicate your acceptance of these terms and conditions of use. If you do not accept these terms and conditions of use, please do not use this Service. There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms of Use. In those cases, the terms specific to the special feature control to the extent there is a conflict with these Terms of Use.
Your use of the Service forms a legal agreement between you and Persona and is subject to the terms of this agreement as stated in Terms and Conditions of Use. You acknowledge and agree that Persona may stop (permanently or temporaliy) providing the Services to you or to users generally, at Persona’s sole discretion, without prior notice to you. You may stop using the Service at any time. You do not need to specifically inform Persona when you stop using Persona. In order to Access Service, you may be required to provide information about yourself (such as identification or contact details) as part of your continued use of the Service. You agree that any registration information you give to Persona will always be accurate, correct and up to date.

Basic Terms

You must be at least 18 years old to use the Service.
By posting to the Service, you agree to be solely responsible for the Content (any material uploaded to Persona by any user, including any photos, videos, audio, data, text (such as comments and hashtags), metadata, images, interactive features, emojis, GIFs, memes, and any other material whatsoever) of all information you contribute, link to or otherwise upload.
You agree that everything you post shall be truthful, accurate, not misleading and offered in good faith, and that you have the right to post such content/material.
Here you have the opportunity to sell your Content on our platform, thus allowing third parties to purchase your Content.
You agree not to post false, misleading or deceptive comments, materials for which Persona does not own the intellectual property rights or have the right to reproduce/upload, trademarked materials, or materials that contain confidential material or violate third party’s right of publicity, any photos or comments that depict unsafe practices, offensive behavior, profanity, personal attacks and illegal statements, content attempting to impersonate someone else including but not limited to customers, clients and employees of the Service, content that is subject to an internal investigation or that refers to, or otherwise speaks to, ongoing litigation matters or investigations.
We cannot comprehensively check Content uploaded on our platform for potential rights violations. If we receive indications of illegal Content or discover violations against third party rights, applicable laws or our Terms of Service, we may, at our sole discretion and without notice, delete such Content from your account.
You can delete Content that you have only shared within the Service directly in your account at any time. Content that has already been shared on Service may still be visible after such deletion.
You agree to keep it appropriate and polite when disagreeing with others’ opinions.
You must not create or submit unwanted email, comments, likes or other forms of commercial or harrassing communications to any Persona users.
You agree that your submission does not contain or constitute any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation and any viruses, worms, spyware, adware or other potentially damaging programs or files.
You will not be compensated or granted any consideration by any third party as regards your posts.
You agree that your submission does not violate any law (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising), You agree that you will not upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary contents.
You agree that you will not download any file posted by another user of the Service that you know, or reasonably should know, cannot be legally distributed in such manner.
You agree that you will not restrict or inhibit any other user from using and enjoying the Service.
You agree that you will not harvest or otherwise collect information about others, including e-mail addresses, without their consent.
You must not change, modify, adapt or alter the Service or change, modify or alter another website so as to falsely imply that it is associated with the Service.
You must not use domain names or web URLs in your username without prior consent from Persona.
You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
By submitting any user submission, you represent and warrant that your submission will not and may not be reasonably considered to be, defamatory, libelous, hateful, racially, ethnically, religiously, or otherwise biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership, or corporation, vulgar, pornographic, obscene, or invasive of another’s privacy.
You agree that you are responsible for all data charges you incur through use of the Service.
We prohibit crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols or technologies used by a search engine with Persona’s express consent).
Violation of these Terms of Use may, in Persona’s sole discretion, result in termination of your Persona account. You understand and agree that Persona cannot and will not be responsible for the content posted on the Service and you use the Service at your own risk. If you violate the letter of spirit of these terms of use, or otherwise create risk or possible legal exposure for Persona, we can stop providing all or part of the Service to you.

Prohibited Content

Persona prohibits the use of the Service by any person or entity that: Provides, sells or offers to sell any of the following products or content (or services related to the same): pornography or illicitly pornographic sexual products, including but not limited to magazines, video and software; escort services; dating services; adult “swinger” promotions; illegal goods; illegal drugs; illegal drug contraband; pirated computer programs; instructions on how to assemble or otherwise make bombs, grenades or other weapons.
Displays or markets material that exploits children, or otherwise exploits children under 18 years of age. Provides, sells or offers products, services or content frequently associated with unsolicited commercial email, a.k.a. spam, such as online and direct pharmaceutical sales, including but not limited to health and sexual well-being products, work at home businesses, credit or finance management, including but not limited to credit repair and debt relief offerings and stock and trading tips, and mortgage finance offers, DJ/nightclub, event/club promotions/party lists, and odds making and betting/gambling services, including but not limited to poker, casino games, horse and dog racing and college and pro sporting events. Provides material that is grossly offensive, including blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity or post any obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable content. Posts or discloses any personally identifying information or private information about children without their consent (or their parents’ consent in the case of a minor).
Sells or promotes any products or services that are unlawful in the location at which the content is posted or received. Introduces viruses, worms, harmful code and/or Trojan horses on the Internet. Engages in any libelous, defamatory, scandalous, threatening, or harassing activity. Posts any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information or assistance in causing or carrying out such violence. Markets to third party voter registration lists. Provides content, including assets, of authors, artists, photographers or others without the express written consent of the content owner. We may, in our sole discretion, immediately disable your access to Service if we believe, in our sole discretion, that you have violated any of the policies listed above or this Agreement.

Virtual Items Policy

Coins

Who can buy Coins?

• Users of our Services who are aged 18 (or age of majority in your jurisdiction) or older may purchase virtual “coins” (“Coins”) from us using authorised payment methods and through payment providers made available and authorized by us.

Purchasing Coins

• The price of the Coins will be displayed at the point of purchase. All charges and payments for Coins will be made in the currency specified at the point of purchase through the relevant payment mechanism. Currency exchange settlements, foreign transaction fees and payment channel fees, if any, are based on your agreement with the applicable payment provider.
• You will be responsible for the payment of any Coins purchased by you. Once your purchase has been completed, your user account will be credited with Coins.
• If you wish to make changes to your purchase, please contact us at the email address set out below. We will let you know if this change is possible. Please note that changes may impact price as well as other aspects of your purchase. If you live in the European Union, you have certain rights to withdraw from a purchase under the Consumer Rights Directive and its implementing legislation. However, if you purchase Coins, you acknowledge and agree that we start supplying the Coins to you as soon as the purchase is complete and therefore, your right to cancel from the agreement to purchase is lost at this point.

How you can use Coins?

• Coins can be used to purchase User Content.
• Coins can only be used on our Platform and as part of our Services, and cannot be combined or used in conjunction with other promotions, coupons, discounts or special offers, except those designated by us.
• Accrued Coins do not constitute property and are not transferable: (a) upon death; (b) as part of a domestic relations matter; or (c) otherwise by operation of law.
• Any Coins assigned, sold, or otherwise transferred without the express written consent of us are void. Any user of the Services who violates this restriction may have his or her account terminated us, forfeit Coins from his or her account, and/or be subject to liability for damages and litigation and transaction costs.
• All Coins of a user will expire automatically upon termination of the user’s account for any reason.
• You agree that we have the right to manage, regulate, control, modify and/or eliminate such Coins, where we have a valid reason to do so such as where we reasonably believe you have violated this Policy, you are in breach of any applicable law or regulation or for legal, security or technical reasons and that we will have no liability to you based on our exercise of such right. If we decided to eliminate Coins from our services completely, we will do so by providing reasonable notice to you.
• The sale, barter, assignment, exchange, transfer or other disposal of any Coins, other than by us, is expressly prohibited.

Withdrawing Coins

• At any point, a User can see how many Coins he/she has accrued on a real-time basis by checking their user account.
• A User can choose, by selecting the relevant options in their user account, to withdraw Coins in exchange for monetary compensation (to be denominated in Turkish Liras). The applicable monetary compensation will be calculated by us based on various factors including the number of Coins a user has accrued.
• The withdrawal of Coins will be subject to the following terms and any additional information provided in the withdrawal instructions that are provided to you at the time of such withdrawal, including the applicable daily limits on withdrawal amounts: the rate of withdrawal will be displayed at the point of withdrawal.
• Any Coins assigned, sold, or otherwise transferred without the express written consent of us are void. Any user of the Services who violates this restriction may have his or her account terminated us, forfeit Coins from his or her account, and/or be subject to liability for damages and litigation and transaction costs.
• All Coins of a user will expire automatically upon termination of the user’s account for any reason.
• You agree that we have the right to manage, regulate, control, modify and/or eliminate such Coins, where we have a valid reason to do so such as where we reasonably believe you have violated this Policy, you are in breach of any applicable law or regulation or for legal, security or technical reasons and that we will have no liability to you based on our exercise of such right. If we decided to eliminate Coins from our services completely, we will do so by providing reasonable notice to you.
• The sale, barter, assignment, exchange, transfer or other disposal of any Coins, other than by us, is expressly prohibited.
• You agree that we have the right to manage, regulate, control, modify and/or eliminate such withdrawal feature where we have a valid reason to do so such as where we reasonably believe you have violated this Policy, you are in breach of any applicable law or regulation or for legal, security or technical reasons, and that we will have no liability to you based on our exercise of such right.
• The applicable cash payment will be made directly into your nominated "International Bank Account" which has an "International Bank Account Number" (IBAN) with Country Code "TR", or other third-party payment channel account (if applicable).
• All your infos need to be an exact match to your "International Bank Account" information such as "International Bank Account Number" and your first and last name. It is your responsibility to ensure that you provide your account information correctly. You are responsible for any losses caused by incorrect account information provided by you. We may, at our sole discretion, request you to provide information to verify your identity (including your first and last name and your state ID number).
• We reserve the right to verify your identity, age (by requesting a photocopy of your state ID card, or other proof as we may require) and eligibility qualifications to our satisfaction prior to making any payment.
• Although we aim to fulfil all withdrawal requests in a timely manner, we do not guarantee fulfilment within a specific period of time (including any estimated timings set out at the time of withdrawal) and we will not be liable to you or any third party for any failure to fulfil a withdrawal request within such time.
• If you are subject to any taxes imposed by any jurisdiction on these payments, you will be responsible for the payment of such taxes (including any related penalties or interest) to the relevant tax authority. We reserve the right to deduct any applicable taxes prior to making such payment if we determine that we are required to do so by applicable law. We also reserve the right to request certifications from you in relation to taxes and to report to tax authorities amounts paid and/or withheld from payments to you.
• We reserve the right to deduct Coins from your account if you are in breach of this Policy.
• We may cancel the operation of the Coin incentive at any time. If we cancel the Coin incentive, we shall make reasonable efforts to provide you with prior notice to enable you to convert your Coins into cash. Where we have a valid reason (such as where we reasonably believe you have violated this Policy, you are in breach of any applicable law or regulation or for legal, security or technical reasons), we may cancel the operation of the Coin incentive without notice. In either case, you shall have no right or entitlement to any financial compensation in respect of any Coin accrued prior to the date of cancellation of the incentive that has not been converted into cash using the mechanism set out in this Policy.
• You may cancel your account at any time, and we may terminate your account in accordance with this Policy. All the Coins in your account will be cancelled immediately upon the cancellation or termination of your account. There will be no refunds for any unused or unredeemed Coins, so we recommend you use or withdraw them before terminating your account.

Withdrawal Instructions

• To request a cash withdrawal, you need to have a withdrawal method that we support in your region or country.
• Make sure your withdrawal method information provided to us is accurate, complete, and up to date. Any fees or losses caused by inaccurate or incomplete withdrawal method information shall be borne by you. We are not responsible for any losses, disputes or other consequences arising from inaccurate or incomplete withdrawal method information you submit.
• Each withdrawal request you make under your selected withdrawal method is also subject to additional conditions displayed at the point of withdrawal. The withdrawal threshold, limit as well as other information displayed on related pages may change at any time at our sole discretion and is subject to any mandatory laws or regulations in the country or region where you reside.
• Withdrawing indicates you agree with our terms of use, these instructions and any additional information provided by Persona to you at the time of withdrawal.

Rights

Persona does not claim ownership of any Content that you post on or through the Service.
You agree that Persona is not responsible for, and does not endorse, Content posted within the Service. Persona does not have any obligation to prescreen, monitor, edit, or remove any Content. If your Content violates these Terms of Use, you may bear legal responsibility for that Content.
You acknowledge and agree that your relationship with Persona is not a confidential, fiduciary, or other type of special relationship, and that your decision to submit any Content does not place Persona in a position that is any different from the position held by members of the general public, including with regard to your Content. None of your Content will be subject to any obligation of confidence on the part of Persona, and Persona will not be liable for any use or disclosure of any Content you provide.
It is Persona’s policy not to accept or consider content, information, ideas, suggestions or other materials other than those we have specifically requested and to which certain specific terms, conditions and requirements may apply. This is to avoid any misunderstandings if your ideas are similar to those we have developed or are developing independently. Accordingly, Persona does not accept unsolicited materials or ideas, and takes no responsibility for any materials or ideas so transmitted. If, despite our policy, you choose to send us content, information, ideas, suggestions, or other materials, you further agree that Persona is free to use any such content, information, ideas, suggestions or other materials, for any purposes whatsoever, including, without limitation, developing and marketing products and services, without any liability or payment of any kind to you.
You agree, confirm and undertake, by adding content, that given by you to Persona, that you grant all kinds of Rights to use and benefit of content and enable to use and benefit from content with broadest scope and meanings designated by legislations for free (without demanding any fee) by adding content to Persona. Unless otherwise indicated, Rights to use and benefit and enable to use and benefit include Rights to use, enable to use, benefit and enable to benefit on including Internet, but not limited to, all kinds of virtual platforms and other communication channels and other on-line and off-line platforms (television, radio, press etc.) within the scope of this article. Within the scope of this article, Rights include all kinds of Rights of processing’s, reproductions, distributions and conveying to public.You, irrevocably accept and declare that You acknowledge that Persona can use Rights and benefit from the Rights by gaining commercial profit within the scope of this article. You, agree, confirm and undertake that You shall have no right to demand any cost or fee from Persona under any name and in any manner for the Rights that have been granted by you to Persona.

Information Collection and Use

For a better experience, we may require you to provide us with certain personally identifiable information, including but not limited to location, internet access informations. The information that we request will be retained on your device and is not collected by us in any way. The app does use third party services that may collect information used to identify you.

Log Data

We want to inform you that whenever you use Persona, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing Persona, the time and date of your use of Persona, and other statistics.

Service Providers

We may employ third-party companies and individuals due to the following reasons:

• To facilitate Persona;
• To provide Persona on our behalf;
• To assist us in analyzing how Persona is used.
• We want to inform users of Persona that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

Account Termination Policy

Persona reserves the right to decide whether any Content or activity, in whole or in part, violates these Terms of Service, and Persona may at any time, without prior notice and in its sole discretion, terminate your account or cease providing you with all or part of the Service, or remove such Content if we reasonably believe:

• (i) you have otherwise violated of these Terms of Service,
• (ii) you create risk or possible legal exposure for us;
• (iii) your account should be removed due to prolonged inactivity; or
• (iv) our provision of the Service to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account, depending on the circumstances.

If Persona terminates your account for cause, as determined in its sole discretion, you agree and acknowledge that all of or your digital records, including but not limited to virtual in-app currency (i.e. Coins, etc.) chat logs, user comments, profile photos, videos and any data generated and stored on the Service will be confiscated, with or without notice.
In other words, play by the rules and adhere, to these Terms of Service, failure to do so will result in the loss of your account and all of its assets.
You may end your legal agreement with Persona at any time by deactivating your account(s) and discontinuing your use of the Service.

Children’s Privacy

Persona do not address anyone under the age of 18. We do not knowingly collect personally identifiable information from children under 18. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.

Termination and Modification of These Terms of Use

Persona reserves the right to change the terms, conditions, and notices under which the Service is offered, including but not limited to the charges associated with the use of Persona.
We reserve the right to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you.
You can delete your Persona account by logging into the Service and selecting "Delete Account "from the account settings. If we terminate your access to the Service or you use the form detailed above to delete your account, your photos, comments, likes, friendships, and all other data will no longer be accessible through your account.
We reserve the right to refuse access to the Service to anyone for any reason at any time.
We reserve the right to force forfeiture of any username for any reason.
We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.

Right to Deletion

You have the right to request that we delete the personal data we collected from you and maintained. If you have an account with us, you can exercise any of the above rights from your profile. If you don’t have a profile or if you are unable to access, control, or delete your information from within your profile, you can contact us at persona.connection@gmail.com

Links to Third Party Sites

Persona may contain links to other Web Sites (“Linked Sites”). The Linked Sites are not under the control of Persona. Persona is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site.

App Stores

To the extent permitted by applicable law, the following supplemental terms shall apply when accessing the Platform through specific devices:
Notice regarding Apple.
By downloading the Platform from a device made by Apple, Inc. (“Apple”) or from Apple’s App Store, you specifically acknowledge and agree that:
These Terms between Persona and you; Apple is not a party to these Terms.
The license granted to you hereunder is limited to a personal, limited, non-exclusive, non- transferable right to install the Platform on the Apple device(s) authorised by Apple that you own or control for personal, non-commercial use, subject to the Usage Rules set forth in Apple’s App Store Terms of Services.
Apple is not responsible for the Platform or the content thereof and has no obligation whatsoever to furnish any maintenance or support services with respect to the Platform.
In the event of any failure of the Platform to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Platform, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Platform.
Apple is not responsible for addressing any claims by you or a third party relating to the Platform or your possession or use of the Platform, including without limitation (a) product liability claims; (b) any claim that the Platform fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
In the event of any third party claim that the Platform or your possession and use of the Platform infringes such third party’s intellectual property rights, Apple is not responsible for the investigation, defence, settlement or discharge of such intellectual property infringement claim.
Google Play.
By downloading the Platform from Google Play (or its successors) operated by Google, Inc. or one of its affiliates (“Google”), you specifically acknowledge and agree that:
to the extent of any conflict between (a) the Google Play Terms of Services and the Google Play Business and Program Policies or such other terms which Google designates as default end user license terms for Google Play (all of which together are referred to as the “Google Play Terms”), and (b) the other terms and conditions in these Terms, the Google Play Terms shall apply with respect to your use of the Platform that you download from Google Play, and you hereby acknowledge that Google does not have any responsibility or liability related to compliance or non-compliance by Persona or you (or any other user) under these Terms or the Google Play Terms.

EXCLUSION OF WARRANTIES

NOTHING IN THESE TERMS SHALL AFFECT ANY STATUTORY RIGHTS THAT YOU CANNOT CONTRACTUALLY AGREE TO ALTER OR WAIVE AND ARE LEGALLY ALWAYS ENTITLED TO AS A CONSUMER.
THE SERVICES ARE PROVIDED “AS IS” AND WE MAKE NO WARRANTY OR REPRESENTATION TO YOU WITH RESPECT TO THEM. IN PARTICULAR WE DO NOT REPRESENT OR WARRANT TO YOU THAT:

• YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS;
• YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR;
• ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; AND
• DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED.
• NO CONDITIONS, WARRANTIES OR OTHER TERMS (INCLUDING ANY IMPLIED TERMS AS TO SATISFACTORY QUALITY, FITNESS FOR PURPOSE OR CONFORMANCE WITH DESCRIPTION) APPLY TO THE SERVICES EXCEPT TO THE EXTENT THAT THEY ARE EXPRESSLY SET OUT IN THE TERMS. WE MAY CHANGE, SUSPEND, WITHDRAW OR RESTRICT THE AVAILABILITY OF ALL OR ANY PART OF OUR PLATFORM FOR BUSINESS AND OPERATIONAL REASONS AT ANY TIME WITHOUT NOTICE

LIMITATION OF LIABILITY

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. THIS INCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS OR SUBCONTRACTORS AND FOR FRAUD OR FRAUDULENT MISREPRESENTATION.
SUBJECT TO THE PARAGRAPH ABOVE, WE SHALL NOT BE LIABLE TO YOU FOR:

• (I) ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY);
• (II) ANY LOSS OF GOODWILL;
• (III) ANY LOSS OF OPPORTUNITY;
• (IV) ANY LOSS OF DATA SUFFERED BY YOU; OR
• (V) ANY INDIRECT OR CONSEQUENTIAL LOSSES WHICH MAY BE INCURRED BY YOU. ANY OTHER LOSS WILL BE LIMITED TO THE AMOUNT PAID BY YOU TO PERSONA WITHIN THE LAST 12 MONTHS.

ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU AS A RESULT OF:

• ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE SERVICE;
• ANY CHANGES WHICH WE MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);
• THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;
• YOUR FAILURE TO PROVIDE US WITH ACCURATE ACCOUNT INFORMATION; OR
